Terms of use

These terms govern your use of this website. They do not govern any engagement — that is set out in a separate services agreement.

1. These terms

This website is operated by MIRAI Foundry Pte Ltd, a company incorporated in Singapore. By using the site you accept these terms. If you do not accept them, please do not use the site.

We may update these terms; the version and effective date at the top of this page will change when we do. Your continued use after an update means you accept the revised terms.

2. Permitted use

You may read, print and share this site for your own business evaluation. You may not:

  • copy, republish or resell its content commercially without our written permission;
  • use automated means to scrape or harvest it at a rate that affects its availability;
  • attempt to gain unauthorised access to it or to any connected system;
  • submit anything unlawful, misleading, or belonging to someone else through our forms.

3. Figures, estimates and examples

Some material on this site is illustrative, and is labelled as such where it appears.

  • The Operational Leakage Estimator is an arithmetic model applied to figures you type in. Its output is an estimate produced from your own assumptions, not a measurement, a forecast, or a promise of savings. The working assumptions are printed beneath the result.
  • Workflow diagrams and product screens are illustrations of how MIRAI OS works. They are not live data.
  • Outcome figures are described in terms of what MIRAI measures. Where a result is shown against a baseline it is marked as representative until it is a client's own measured figure.

Nothing on this site should be relied on as a projection of results in your business. Results depend on your systems, your data and your team.

4. No offer and no professional advice

This site is information about our services. It is not an offer capable of acceptance, and it is not legal, financial, tax or regulatory advice. Any engagement begins only when a written services agreement is signed by both parties, and that agreement — not this site — sets out what is delivered, on what terms, and with what liability.

5. Intellectual property

All content on this site — text, layout, design, the MIRAI marks and wordmark, the M-System marks, and the MIRAI Design System — is owned by MIRAI Foundry Pte Ltd or used under licence, and is protected by copyright and trade mark law.

The MIRAI name, the momentum M and the M-System marks may not be used without our written permission. Typefaces used on this site are licensed from their respective foundries.

6. Third-party names and trade marks

Names of third-party software appear on this site only to describe systems MIRAI connects to. Those names and marks belong to their respective owners. Their appearance does not imply a partnership, endorsement, certification or affiliation unless we state one explicitly.

Where we link to a third-party site we do so for convenience. We do not control those sites and are not responsible for their content, security or privacy practices.

8. Availability

We aim to keep this site available and accurate, but we provide it "as is". We may change, suspend or withdraw any part of it without notice. Availability of this website says nothing about the availability commitments in a signed services agreement.

9. Liability

To the fullest extent permitted by Singapore law, MIRAI Foundry Pte Ltd is not liable for any indirect or consequential loss, or for any loss of profit, revenue, data or anticipated savings, arising from your use of this website or reliance on its content.

Nothing in these terms excludes or limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be excluded.

10. Governing law

These terms and any dispute arising from them are governed by the laws of the Republic of Singapore, and the courts of Singapore have exclusive jurisdiction.
